Welcome to Freshrooms!
The terms “we”, “us”, and “our” refer to Freshrooms, Račianska 37, 831 02 Bratislava, Slovakia.
Freshrooms operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”).
Freshrooms is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) together with any policies referenced herein describe your rights and responsibilities when you use our Services.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, please do not use our Services.


SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm that you are at least the age of majority in your country of residence and that you consent to allow any of your minor dependents to use the Services under your supervision.
You agree to provide accurate, current and complete information when using our Services, including during checkout. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.


SECTION 2 – OUR PRODUCTS

We make every effort to display our products accurately. However, colors or appearance may vary depending on your device and settings.
We do not warrant that the quality or appearance of any product or service will meet your expectations. Product descriptions and availability are subject to change without notice. We may discontinue or limit quantities of any product at any time.


SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. We may accept or decline your order at our discretion.
An order is confirmed once payment is successfully processed and you receive an order confirmation email.
Please review your order carefully before submitting. Once accepted, cancellations may not always be possible.
Your purchases are subject to our Refund Policy 
You agree that your purchases are for personal or household use and not for resale.


SECTION 3A – RIGHT OF WITHDRAWAL (EU CUSTOMERS)

If you are an EU consumer, you have the right to withdraw from your purchase within 14 days without giving any reason.
The withdrawal period expires 14 days after you, or a person designated by you (other than the carrier), acquires physical possession of the goods.

You must return the goods to us no later than 14 days from notifying us of your decision.
You will bear the direct cost of returning the goods unless otherwise stated.

Refunds will be issued using the same payment method you used for the purchase, unless you agree otherwise. We may withhold a refund until we have received the goods back or proof of return, whichever comes first.
Please note that products which by nature cannot be returned for hygiene, safety, or contamination reasons (e.g. inoculated bags, used culture, opened or damaged packaging) are excluded from withdrawal in accordance with Article 16 of Directive 2011/83/EU.


SECTION 4 – WARRANTY AND COMPLAINTS

All products purchased from us are covered by a 24-month legal warranty for defects, in accordance with EU consumer protection laws.
If a product is defective, you are entitled to have it replaced or refunded, depending on the nature of the defect.
To file a complaint, don't hesitate to get in touch with us at info@freshrooms.eu with your order number and details of the issue.
We will respond to your complaint within 14 days.


SECTION 5 – PRICES AND BILLING

All prices are listed in EUR and include taxes where applicable, unless otherwise stated.
Shipping, customs, and import fees are shown at checkout. Prices and promotions may change without notice.
You agree to provide accurate and complete billing and payment information and authorize us to charge your payment method for all orders placed.


SECTION 6 – SHIPPING AND DELIVERY

Delivery times are estimates only and not guaranteed.
We are not liable for carrier delays, customs procedures, or events beyond our control.
Ownership and risk of loss pass to you once the goods are handed over to the shipping carrier.


SECTION 7 – INTELLECTUAL PROPERTY

All content on our website—including trademarks, designs, text, images, videos, and layouts—is the property of Freshrooms or its licensors and is protected by intellectual property laws.
You may use our Services only for personal, non-commercial purposes. Any reproduction or redistribution without written permission is prohibited.
“Freshrooms” names, logos, and designs are trademarks of Freshrooms. Shopify’s trademarks belong to Shopify Inc. All other marks remain the property of their respective owners.


SECTION 8 – OPTIONAL TOOLS AND THIRD-PARTY LINKS

You may be given access to tools or links operated by third parties. These are provided “as is” without warranties.
We are not responsible for third-party content, websites, or products. Your use of such tools or links is entirely at your own risk and subject to the third party’s terms.


SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify. While Shopify provides the technical platform, all sales and transactions occur directly between you and Freshrooms.
Shopify is not responsible for any claims, damages, or losses resulting from your transactions with Freshrooms.


SECTION 10 – PRIVACY POLICY (GDPR COMPLIANCE)

We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Slovak Act No. 18/2018 Coll. on Personal Data Protection.
Our Privacy Policy explains what data we collect, how we use it, and your rights, including access, rectification, erasure, data portability, and objection.
By using our Services, you acknowledge that we and Shopify may process your data for order fulfillment, fraud prevention, analytics, and support.

We reserve the right to correct any errors, inaccuracies, or omissions in product information, pricing, or availability, and to cancel or update orders if such information is inaccurate—even after submission.

To the maximum extent permitted by law, Freshrooms, its owners, employees, and partners shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services or products, except in cases of willful misconduct or gross negligence.

You agree to indemnify and hold harmless Freshrooms, Shopify, and their affiliates against any claims, damages, or expenses arising from your breach of these Terms or violation of applicable law.


SECTION 18 – SEVERABILITY

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.


SECTION 19 – ENTIRE AGREEMENT AND WAIVER

These Terms, together with our policies, constitute the entire agreement between you and Freshrooms.
Any failure to enforce a right does not constitute a waiver of that right.


SECTION 20 – ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign or delegate these Terms without notice.


SECTION 21 – GOVERNING LAW AND JURISDICTION

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the Slovak Republic and the European Union.
Any disputes shall be resolved by the competent courts of the Slovak Republic, specifically the courts of Bratislava.


SECTION 22 – CHANGES TO THE TERMS

We may update or modify these Terms at any time by posting an updated version on our website.
Material changes will be communicated in accordance with applicable law. Continued use of our Services after changes constitutes acceptance.
